General Conditions of Sale (GTC)
Any order under a product appearing in the online store site www.silumen.com requires consultation and prior acceptance of these terms and conditions of sale. The validation click of the order implies full acceptance of the present. This click has value of "digital signature".
These terms and conditions are intended to define the rights and obligations of the parties in connection with the online sale of goods offered by THE FIRST company on our website www.silumen.com to the consumer.
The contractual information will be confirmed by e-mail to the address indicated by the consumer in the purchase form.
Proof of the transaction
The computerized registers, stored in THE FIRST computer systems under reasonable security conditions are considered as proof of communications, orders and payments.
Exchanges between the parties
The filing of purchase orders and invoices is done on a reliable and durable support that can be produced as evidence.
Every effort has been made to ensure the accuracy of the information presented on www.silumen.com. THE FIRST company or its suppliers are not however responsible for the consequences, incidents, special damages resulting from the electronic transmissions or the accuracy of the information transmitted even if THE FIRST Company had knowledge of the possibility of such damage. Names and brands of products and manufacturers are used for identification purposes only.
We reserve the right, but are not obliged to do so, to limit the sales of our products to any person, and in any geographic area or jurisdiction. We could exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any product or service we offer.
All product descriptions and product prices are subject to change at any time without notice, in our sole discretion. We reserve the right to stop offering a product at any time. Any offer of service or product presented on this site is void where the law prohibits it.
Validity period of the offer and the price thereof
Our prices are valid for the day.
All our prices are shown in HT for business customers and TTC for individuals.
Delivery time: Delivery times can not exceed 30 days unless special agreement decided with the customer.
Our preparation times are from 48h to 72h and we must add 48h to 72h more for the delivery date.

The products are delivered to the address indicated by the consumer on the order form and only in the geographical areas that we serve.
The delivery rate is fixed. THE FIRST reserves the right to involve the provider and services of his choice for all orders placed on the site.
Delivery problem due to the carrier
We do not accept any responsibility for longer delivery times due to the carrier, especially in case of loss of products, bad weather or strike.
As in any shipment, it is possible to be late or the product goes astray. In such a case, we contact the carrier to start an investigation. All efforts are made, as long as necessary, to find this package. If necessary the merchant will deliver a new package identical to his expenses or refund the total amount of the order.
All products leave our logistic depot in perfect condition. The customer must report to the carrier (or postman) the slightest trace of shock (holes, traces of crushing, etc.) on the package, and if necessary to refuse the package. An identical new product will be returned to you at no cost.
If you are not able to check your entire package during delivery or you prefer to accept the package despite its apparent deterioration, you have 48 hours (two working days) to report to us after unpacking, the receipt of an item broken or damaged.
Delivery failed for "Incomplete or incorrect or missing address"
Please note that the deadline of 15 consecutive days is not exceeded to pick up your parcel in your postal office or point of withdrawal.
The credit note or refund will be reduced by the amount of the delivery costs incurred by THE FIRST including during operations "Free Shipping" since our company pays in all cases the amount of delivery to the carrier.
In the case where the parcel is returned for a reason which is attributable to you (unclaimed parcel, erroneous / incomplete address ...), you will have to pay new delivery charges before any forwarding of the parcel if the postage paid was not achieved.
This paragraph concerns the missing products in the parcel or the articles received in place of those ordered following an error of preparation of order.
You must formulate with THE FIRST company, at the latest in the 8 working days following the delivery, any delivery error compared to the indications appearing on the purchase order.
Beyond this deadline, any claim will be rejected. The formulation of this claim with THE FIRST can be done by form accessible to the heading "Informations> Contact"
Any claim not made in the rules defined above and within the time limits can not be taken into account and release THE FIRST from any responsibility vis-à-vis the consumer.
In the event of a delivery error, any product to be exchanged or refunded must be returned to THE FIRST as a whole and in its original packaging in perfect condition at the logistics depot at the following address: The First - Mandarin And Co, 86-114 Avenue Louis Roche, Bâtiment B Hall 303, 92230 Gennevilliers, FRANCE.
To be accepted, any return must be reported and have the prior agreement of the SELLER, who in case of agreement will forward the package to the correct address.
Right to retract
The right of withdrawal only applies to natural persons.
In accordance with Articles L. 120-20, the consumer has a period of fourteen (14) calendar days to return, at its expense, the products do not suit him. This period runs from the day of receipt of the consumer's order. All returns may be reported in advance to THE FIRST customer service. The product must be returned to the logistics depot located at the following address: Mandarin And Co, 86-114 Louis Roche Avenue, Bâtiment B Hall 303, 92230 Gennevilliers, FRANCE.
Only products returned as a whole, in their original packaging complete and intact, and in perfect condition of resale will be taken back. Any product that has been damaged, or whose original packaging has been damaged, will not be refunded, returned or exchanged. This right of withdrawal is exercised without penalty, with the exception of shipping and return. In the hypothesis of the exercise of the right of retraction, the consumer has the choice to ask for either a refund of the sums paid equal to the value of products, or the exchange of the product. In the case of an exchange, the return will be at the expense of the consumer.
In case of exercise of the right of withdrawal, THE FIRST will refund the consumer within a maximum period of fifteen (15) working days from the return date of the goods.
To exercise his right of withdrawal the consumer may use the form available on the website www.silumen.com, by mail or e-mail via the contact section of our site.
The provisions herein can not deprive the consumer of the legal guarantee that obliges the professional seller to guarantee against all consequences of latent defects of the thing sold.
The consumer is expressly informed that THE FIRST is not the manufacturer of the products presented in the site www.silumen.com and that he releases himself from any responsibility because of the defective products.
Consequently, in case of damage to a person or a product by default of the product, only the responsibility of the manufacturer of it may be sought by the consumer, based on the information on the packaging of the product.
The warranty period is two years (2 years). This guarantee does not include:
- all products modified or repaired by the customer or by any other entity than the service providers chosen by the SELLER.
- all products used in conditions not intended for their use.
- all bulbs except LED bulbs and bulbs with an indication to the contrary on the article sheet.
All requests for collateral with THE FIRST must be made by means of a form accessible under the heading "Information> Contact". Upon request of the after-sales service, the products must be returned, well packaged (not to suffer damage upon delivery) to THE FIRST for examination at the expense of the customer. All costs of repair, replacement and return to the customer will be the responsibility of THE FIRST.
Neither party will have failed in its contractual obligations, to the extent that their performance will be delayed, hindered or prevented by a fortuitous event of force majeure. Will be considered as a case of force majeure any fact or circumstance irresistible, outside the parties, unpredictable, inevitable, independent of the will of the parties and which can not be prevented by the latter, despite all efforts reasonably possible.
The party affected by such circumstances will notify the other within ten business days of the date on which it becomes aware of it.
The two parties will then approach, within three months, unless impossible due to force majeure, to examine the impact of the event and agree on the conditions under which the execution of the contract will be continued. If the case of force majeure has a duration greater than a duration of one month, these terms and conditions may be terminated by the injured party.
Expressly, are regarded as case of force majeure or fortuitous cases, besides those which are usually retained by the jurisprudence of the French courts and tribunals: the blockage of means of transport, earthquake, fires, storms, flood, lightning, the shutdown of telecommunication networks or difficulties specific to telecommunication networks external to customers.
If one or more stipulation of the present general conditions are held for not validated or declared such according to a law, a regulation or following a final decision of a competent jurisdiction, the other stipulations will keep all their force and their reach.
The fact for one of the parties not to claim a breach by the other party to any of the obligations under these terms and conditions of sale can not be interpreted for the future as a claim the obligation in question.
These general conditions are subject to French law. This is so for the fund rules as for the rules of form.
In case of dispute or claim, the consumer will first contact THE FIRST for an amicable solution.
Protection of personal data
All the data you entrust to us are so that we can process your orders.
Under Law No. 78-17 of 6 January 1978 relating to data, files and freedoms, you have with the SELLER a right to rectify, consult, modify and delete data that you us have communicated. This right can also be exercised online.
Any order placed through the website www.silumen.com carries the customer's adherence, without any restriction, to the general conditions of sale of THE FIRST.
In the event of sale to a legal person, any difference relating to the sale (price, GTC, products, ...) will be subject to French law before the Commercial Court of the registered office of the company THE FIRST.
